Wrongful Death Lawsuit an Option After Semi Kills Couple

Too often do family and friends have to say an earthly farewell to a loved one because another person was negligent while driving. The option of filing a wrongful death lawsuit against the perpetrator is available in most cases of death due to negligent or reckless behavior. The family of a Georgia couple appears to have grounds to pursue financial damages from a wrongful death lawsuit after the death of a couple. The husband and wife, both 71 years of age, were in their Ford F-150 and were traveling through an intersection when a semitrailer ran a stop sign. The pickup hit the side of the semi, causing the semi to roll on top of the pickup truck. The couple died upon impact. Georgia State Patrol officials have not released details of the accident but state they are still investigating the matter. They indicated that charges will likely be issued to the 30-year-old…

Wrongful Death Claim Can Be Filed in Hit-and-Run Case

Georgia residents who own dogs know their pets need to be walked on a daily basis. Most set out at a convenient time of day to ensure the dog gets the exercise it needs, never thinking it may end in tragedy. A family lost someone they loved in a wrongful death accident when he was walking his dog. The woman believed responsible apparently left the scene but has been identified by police. The 66-year-old man was in his own yard when a vehicle, suspected to be a silver Infiniti and going too fast for the weather conditions at the time, hit him and his dog. Both the man and the dog were killed instantly. Later in the day and less than a mile away, police found the vehicle they believed to be used in the hit-and-run accident. Police discovered the owner of the vehicle was in jail but used various means,…

Boy Killed in Crash, Family Has Right to File Wrongful Death Suit

A needless death at any age is devastating, but to lose a teenager because of the negligence of another person is indescribable. Many family members who have lost a child, parent, or spouse, as a result, have filed a wrongful death lawsuit, in part, to hold the negligent individual responsible for his or her actions. A Georgia family will have the option to file a wrongful death lawsuit after the death of their 17-year-old son. According to information in police reports, a 17-year-old driver was alarming his three passengers as he was driving erratically down the road. He crashed into a tree after losing control of the vehicle. The crash caused flames to erupt, engulfing the entire vehicle. A 911 call was made, but dispatchers had difficulty determining where the vehicle was located. The passenger in the front was killed in the crash, and the other two in the back seat…

Potential for Wrongful Death Lawsuit After Fatal Collision

The needless loss of life because of the negligence of another person is often devastating to loved ones left behind. Typically, a wrongful death lawsuit can be filed against the person deemed responsible for the death, often bringing a measure of comfort to grieving family members. The family of a Georgia woman likely have cause to file a wrongful death lawsuit after a collision killed her and her daughter. The woman, a criminal justice professor at Georgia College, and her 15-year-old daughter were traveling on a two-lane highway when a pickup truck headed toward them crossed over into their lane and hit them head-on. A sheriff's deputy at the scene stated the deaths of the mother and daughter were instantaneous. The driver of the pickup truck survived but was injured. The 38-year-old pickup driver was transported to a local hospital, where he was treated for several injuries, including a broken pelvis.…

First Grade Girl Killed in One of Georgia’s Fatal Accidents

Each day, parents in Georgia put their children on school buses out of convenience or necessity. These parents trust the bus drivers to get their precious loved ones safely to school and back home, never even thinking of the day they might not see their child again. Although the number of fatal accidents involving a school bus is lower than those of other vehicles, any life lost is devastating to family and friends. A young girl was killed in one of those fatal accidents, and the bus driver was recently arrested on newly developed charges. In January 2018, the driver was taking her load of children home after school when she lost control of the bus as it came to a curve in the road. Investigations showed she was driving too fast for the trajectory of the road. The bus landed on its side after leaving the road and rolling. A…

Passenger Fatality May Lead to Wrongful Death Lawsuit

Death as a result of another person's negligent actions can be devastating to family and friends left behind. Once grief has somewhat abated, a course of action is often taken in the form of a wrongful death lawsuit. The family of a 42-year-old Georgia man may soon be contemplating filing their own wrongful death lawsuit after he was killed in a recent car accident. The initial investigation shows that the 34-year-old driver of a BMW convertible lost control of his car and crashed off the side of the road. The impact threw the passenger from the vehicle, causing serious injury. The driver was also injured although not as severely as his friend. Emergency rescue personnel took both men to a nearby hospital where the passenger died as a result of his injuries. At the time of a report on the accident, the driver had been admitted to the hospital but is…

Interstate Highways Often Scenes of Fatal Accidents

Losing a loved one is never easy but it seems even harder to accept when the loss is due to the negligence of another person. Fatal accidents are often caused by someone who is not giving sufficient attention to the task at hand, usually in operating some type of machine that is capable of causing grave injuries, such as a car or truck. A Georgia man was recently a victim in one of the state's latest fatal accidents as he was traveling on Interstate 20. The 3 a.m. collision occurred when the young driver of a BMW sedan hit the back end of a 2009 Nissan. The driver of the BMW was speeding and following the other vehicle too closely at the time of the crash. Police also believe he had been drinking not long before the crash. Neither vehicle was able to stay on the highway. The impact was…

Fatal Accidents Caused by Negligent Driving

Deadly crashes can happen at any time and to any person, no matter what precautions a driver may take. There is no guarantee that other drivers are as careful on the road, that weather conditions are always perfect for driving, and that deer and that other animals do not dart out in front of a moving vehicle. A Georgia man has been sentenced after his conviction in causing one of the state's fatal accidents nearly two years ago. A report on the court proceedings did not give details of the crash, only that the driver was speeding when his car crashed into another vehicle carrying four members of one family. The mother and two of her children were injured, but her third child, a 19-year-old man, was killed. One of the children still experiences debilitating pain from her injuries. The 24-year-old driver accused and convicted of a host of charges, including…

Georgia Power Accused of Negligence in Wrongful Death Suit

The treatments for cancer or other serious illnesses can be harsh on a patient's body and can be difficult to recover from. Sometimes, these treatments can even cause permanent damage. Depending on the illness and the treatment, patients may be permanently reliant on things like oxygen tanks or other healthcare equipment. When this equipment is compromised, the results may be deadly, as was the case for a Georgia woman whose power was turned off despite her efforts and the efforts of her family and her doctors to keep the power on. After her death, a wrongful death suit was filed against Georgia Power, claiming negligence. A woman was recovering from cancer treatment and required oxygen in her home when the power was cut off. Paramedics were dispatched to her home and confirmed that she had suffered acute respiratory failure as well as low oxygen in her blood and tissue. She was…

Family Files Wrongful Death Suit After Child Dies at Day Camp

Summer is fast approaching, and some Georgia residents are dreading the heat, while others are looking forward to it. Many parents and children are getting ready for various camps and activities that will begin with at the end of the school year. While most of the time these camps and activities are a source of fond memories, occasionally they are plagued by tragic events. The parents of a 5-year-old boy filed a wrongful death suit after their son died while under the care of camp counselors in July, 2017. The child attended a local day camp at a nature center with 12 other campers and well as three camp counselors on the day that he died. The campers were taken on a short hike and fed lunch before being allowed to play in some nearby shallow water under the supervision of the counselors. Unfortunately, the adults failed to notice the little boy as…
