Why Atlanta Drivers Call Dozier Law After a Wreck
- Nearly 60 years of experience. Dozier Law has fought for crash victims across Georgia since 1966, with offices in Atlanta, Macon, Savannah, Albany, and Tifton.
- We investigate fast. Our investigators photograph the scene, find witnesses, and work to secure traffic camera and dashcam video before it’s erased. We bring in accident reconstruction experts when fault is disputed.
- We handle the insurance company. You focus on recovering; we handle the calls, the paperwork, and the lowball offers.
- No fee unless we win. We work on contingency, so there is no upfront cost to hire us.
- We handle the complicated cases. Multi-vehicle interstate pileups, commercial trucks, and Uber and Lyft crashes often involve several insurance policies. We sort out who is responsible and pursue every source of recovery.
Car Accidents in Metro Atlanta
Crashes are now one of the leading causes of violent death in metro Atlanta. A Propel ATL report found that 425 people died in traffic crashes across five metro counties in 2024, more than the 410 homicides recorded that year. DeKalb County had the most traffic deaths, and Fulton County had the most serious injuries.
Dangerous Roads and Interchanges in Atlanta
We see crash cases from the same stretches of road again and again:
- The I-20 / I-285 interchange in DeKalb County, where police data showed 2,423 crashes and 10 deaths from 2020 into 2023
- Spaghetti Junction (I-85 / I-285) and the rest of the Perimeter, where heavy truck traffic and constant lane changes lead to sideswipes and pileups
- The Downtown Connector (I-75 / I-85), one of the most congested stretches of interstate in the country
- GA-400, especially at rush hour and near the I-285 interchange
- Surface roads such as Buford Highway, Moreland Avenue, Memorial Drive, and Candler Road, with frequent turning traffic and pedestrian crossings
Common Causes of Atlanta Car Accidents
- Distracted driving, despite Georgia’s Hands-Free law
- Speeding and aggressive lane changes on I-285, I-75, I-85, and GA-400
- Following too closely in stop-and-go interstate traffic
- Drunk or drugged driving
- Red-light running and failure to yield at intersections
- Tractor-trailers and delivery vehicles
- Rideshare drivers distracted by their apps
What to Do After a Car Accident in Atlanta
- Call 911. The Atlanta Police Department handles crashes inside city limits; DeKalb County Police or a local city department covers most other areas, and the Georgia State Patrol often works interstate crashes.
- Get medical care. Grady Memorial Hospital is metro Atlanta’s Level I trauma center. Some injuries, like concussions and soft-tissue damage, don’t show symptoms right away.
- Document everything. Photograph the vehicles, the scene, road conditions, and your injuries. Get the other driver’s insurance information and witness phone numbers.
- Don’t admit fault or give a recorded statement. Anything you tell the other driver’s insurer can be used to reduce your claim.
- Get your crash report from the agency that responded to the crash.
- Call an Atlanta car accident lawyer while evidence is still fresh.
How Georgia Law Affects Your Car Accident Claim
Georgia Is an At-Fault State
The driver who caused the crash, and their insurer, pays for your losses. Georgia requires at least $25,000 per person and $50,000 per accident in bodily injury liability coverage. In serious crashes that is rarely enough, so we also look at uninsured/underinsured motorist (UM/UIM) coverage, employers of at-fault drivers, rideshare companies’ policies, and trucking companies.
The 50% Comparative Fault Rule
Under O.C.G.A. § 51-12-33, you can recover damages as long as you were less than 50% at fault. Your recovery is reduced by your share of the blame, and insurers often try to shift fault onto you.
Filing Deadlines
You generally have two years from the crash to file a personal injury lawsuit in Georgia and four years for property damage. Claims against a city, county, MARTA, or state agency can require written notice much sooner.
Georgia’s 2025 Tort Reform
Senate Bill 68, signed April 21, 2025, changed several rules for car accident cases:
- The defense can now raise seatbelt non-use to argue your injuries were worse than they had to be.
- Medical damages focus on what was actually paid, not only what was billed.
- Pain-and-suffering arguments at trial must be tied to the evidence.
These changes make early documentation and an experienced trial lawyer more important than ever.
Compensation You May Recover After an Atlanta Car Wreck
- Medical bills, now and in the future
- Lost wages and lost earning capacity
- Pain and suffering and emotional distress
- Property damage and rental car costs
- Permanent injury, scarring, or disability
- Wrongful death damages for families who lost a loved one
- Punitive damages in drunk driving or extreme recklessness cases
How Much Is an Atlanta Car Accident Case Worth?
There is no average that applies to your case. Value depends on how badly you were hurt, the cost of your medical care, how long you were out of work, how clear fault is, and how much insurance coverage is available. A minor soft-tissue claim may resolve for a few thousand dollars; a crash causing surgery, permanent injury, or death can be worth far more. Past results do not guarantee a future outcome, but we can give you an honest assessment in a free consultation.

Atlanta Car Accident FAQs
How much do car accident lawyers charge in Georgia?
Most Georgia car accident lawyers, including Dozier Law, work on contingency. There’s no upfront cost, and if there is no recovery, you owe no attorney’s fee.
How do I choose a car accident lawyer in Atlanta?
Look for a firm that handles car accident cases every day, will take your case to trial if the insurer won’t pay fairly, and charges nothing upfront. Ask who will actually work on your case and how often you’ll hear from them. We’re happy to answer those questions in a free consultation.
How much of a $25,000 settlement will I keep?
It depends on the attorney’s fee, any case costs, and medical liens that must be repaid. We walk you through the numbers before you accept any offer, so you know exactly what you’ll take home.
What is the average car accident settlement in Georgia?
There isn’t a meaningful average, because values range from a few thousand dollars for minor injuries to much larger amounts for catastrophic ones.
How long do I have to file a car accident claim in Georgia?
Two years from the date of the crash for injury claims and four years for property damage. Claims involving a government vehicle, MARTA, or a public road can have much shorter notice deadlines.
What if I was partly at fault?
You can still recover if you were less than 50% at fault. Your compensation is reduced by your percentage of fault.
What if an Uber or Lyft driver caused my crash?
Rideshare companies carry insurance that may apply depending on whether the driver was logged in, waiting for a ride, or carrying a passenger. Learn more on our Atlanta rideshare accident page.
