Macon Motorcycle Accident Attorneys Who Fight Rider Bias

Motorcycle riders in Macon have almost no protection when a car or truck pulls out in front of them. A crash that would leave a driver with bruises can leave a rider with broken bones, road rash, a brain injury, or worse. And when it is time to deal with the insurance company, riders often face an unfair assumption that they must have been speeding or riding recklessly. Dozier Law has represented injured Middle Georgians from our office at 487 Cherry Street in downtown Macon since 1966. We know how to push back against rider bias with evidence, and we fight for the full value of your claim. You pay nothing unless we recover money for you. How Most Macon Motorcycle Crashes Happen

Most motorcycle accidents are caused by other drivers, not riders. The most common scenarios we see include:

  • Left-turn crashes. A driver turning left at an intersection fails to see or yield to an oncoming motorcycle.
  • Lane changes and merges. A driver moves into a lane without checking the blind spot.
  • Rear-end collisions. A distracted driver fails to stop behind a motorcycle in traffic.
  • Drivers pulling out of parking lots, driveways, and side streets into a rider’s path.
  • Dooring on downtown streets when a parked driver opens a door into traffic.
  • Road hazards such as potholes, gravel, uneven pavement, and debris.
  • Impaired and distracted drivers, including drivers using their phones.

We regularly see crashes on I-75 and I-16, Eisenhower Parkway, Gray Highway, Riverside Drive, Pio Nono Avenue, and Hartley Bridge Road, as well as on the rural two-lane roads riders enjoy outside the city.

Common Motorcycle Accident Injuries

  • Traumatic brain injuries and concussions, even with a helmet
  • Spinal cord injuries and paralysis
  • Broken legs, arms, pelvis, and ribs
  • Severe road rash, skin grafts, and scarring
  • Internal injuries
  • Amputations

These injuries often require surgery, months of rehabilitation, and time away from work. Some are permanent. Your claim should account for future medical care and lost earning capacity, not just the bills you have today. When a crash takes a rider’s life, the family may have a wrongful death claim.

Georgia Motorcycle Laws That Affect Your Claim

Helmets and Eye Protection

Georgia requires every motorcycle operator and passenger to wear approved protective headgear, and riders without a windshield must wear approved eye protection (O.C.G.A. § 40-6-315). If you were not wearing a helmet, you may still have a claim, but the insurance company may argue that some of your injuries would have been less severe. Talk to a lawyer before assuming you cannot recover.

Lane Rules

Georgia gives motorcycles the right to full use of a lane, and other drivers may not crowd a rider out of it. Riders may not pass a vehicle in the same lane or ride between lanes of traffic, which is often called lane splitting, and no more than two motorcycles may ride side by side in one lane (O.C.G.A. § 40-6-312).

Shared Fault

Under Georgia’s modified comparative fault rule (O.C.G.A. § 51-12-33), your recovery is reduced by your percentage of fault, and you cannot recover if you are found 50 percent or more at fault. Insurers often try to shift blame onto riders, which is why an early investigation matters.

Filing Deadline

In most cases you have two years from the date of the crash to file a personal injury lawsuit in Georgia (O.C.G.A. § 9-3-33). Claims involving a government vehicle or road defect can require written notice much sooner.

Macon Motorcycle Accident FAQs

Can I still recover if I wasn’t wearing a helmet?

Often, yes. Not wearing a helmet does not cause a crash, and you may still recover for injuries the other driver caused. The insurer may argue that a helmet would have reduced some injuries, so it is important to have a lawyer evaluate your case.

Is lane splitting legal in Georgia?

No. Georgia law prohibits riding between lanes of traffic or between rows of vehicles. If you were lane splitting when the crash happened, you may still have a claim, but your share of fault will be an issue.

What if the driver who hit me doesn’t have enough insurance?

Your own uninsured or underinsured motorist coverage may help. We review every available policy, including the other driver’s coverage and your own.

How much is my motorcycle accident case worth?

It depends on your injuries, your medical bills and lost income, the long-term effect on your life, who was at fault, and the insurance available. We can give you an honest assessment after reviewing the facts.

How much does a Macon motorcycle accident lawyer cost?

Dozier Law works on a contingency fee. There is no upfront cost, and you pay no attorney’s fee unless we recover money for you.
